Terms and Conditions


  1. Introduction

1.1 These are the terms and conditions (Terms) for the MyMacca’s® app, the McDelivery® platform, and our website, and social media platforms.

1.2 MyMacca’s, including the MyMacca’s Rewards program (MyMacca’s), the MyMacca’s mobile ordering application (MyMacca’s App), the McDelivery® platform (McDelivery Platform), the MyMacca’s website (Website) and all associated platforms and social media channels (together, the Service) are owned and operated by McDonald’s Australia Limited (ABN 43 008 496 928) and/or any of our franchisees, affiliates, subsidiaries or related bodies corporate (McDonald’s or we, us or our).

1.3 When you download, access, or use any part of the Service, for example by applying to join MyMacca’s, accessing or using the Website, using the McDelivery Platform and/or ordering through the MyMacca’s App, you accept these Terms.

1.4 If you do not agree with these Terms, you should not use the Service.

1.5 We can change, suspend or terminate the Service (or any part of it) at any time without notifying you first.

1.6 You may only use the Service and provide personal information if you are an Australian resident aged 15 years or over. If you are under 18, you need your parent or guardian’s consent.

1.7 Once you use the Service, you are bound by these Terms. If applicable, your parent or guardian who provided consent on your behalf will also be bound.

  1. How to Join MyMacca’s

2.1 You must join MyMacca’s to receive and redeem Benefits (explained below), make Contributions to the Website, and/or participate in MyMacca’s generally.

 2.2 You can join MyMacca’s by:

  • Downloading the App onto your device, providing your given name, family name, current email address, and Australian postcode for your home address. We’ll then send you an activation email and you’ll need to follow the prompts (including the requirement to accept the MyMacca’s Terms and Conditions); or
  • using social sign-in via a social media platform as shown on the registration page; or
  • using another method we provide to you and following the prompts set out in that invitation to create an account (Account).

2.3 You must provide current, correct and complete information when you register your Account.

2.4 You are only able to register and maintain one (1) Account and the Account must be in your own name. You must not use another member's Account.

2.5 You can manage your Account via the MyMacca’s App, including changing any of the information provided and deleting your Account.

2.6 We can refuse membership and Account registration requests. This includes where you have previously been banned from the Website or another website.

2.7 We can refuse requests for log-ins that are the same as or similar to existing log-ins; or are inappropriate, offensive, obscene, abusive, defamatory or illegal; or infringe copyright, contain brand names, company names, or registered trade marks; or contain names of high profile or public figures; or contain words promoting political, religious, social, or economic issues; or use the name of another person.

2.8 We may ask you to produce ID to confirm your details and eligibility. If you choose not to provide ID, we may cancel your Account.

2.9 You must keep your Account details confidential. You are responsible for any activity on your Account. You must immediately notify us of any unauthorised use of your Account or any other security breach.

2.10 It is your responsibility to delete your Account when you no longer wish to be a member.

2.11 MyMacca’s and Benefits will continue for as long as we decide.

2.12 If we terminate MyMacca’s, you will have until 90 days from the termination, or until the expiration date of your Benefits, whichever is earlier, to use your Benefits. We will not be liable for the termination of MyMacca’s or loss of your Benefits.

2.13 We sometimes offer promotions for MyMacca’s members which are subject to additional terms as well as these Terms. We also run other promotions and competitions outside MyMacca’s. They are run in accordance with their own terms.

2.14 You need to be a MyMacca’s member to use the McDelivery Platform and the MyMacca’s App.

  1. Benefits

3.1 We may offer services, loyalty points and rewards, gifts, prizes or other benefits to MyMacca’s members (Benefits). The Benefits may be provided by us or a third-party (Benefit Partner). We decide about the nature, quantity, availability and award of Benefits in our discretion. Additional details about our MyMacca’s Rewards program are set out in section 5 and in the MyMacca’s App.

3.2 To redeem a Benefit, you must follow the instructions provided by McDonald’s and/or the Benefit Partner. You are responsible for any additional costs which you incur in redeeming a Benefit, such as travelling to and from a McDonald’s restaurant.

3.3 You must redeem a Benefit within the time stated. Otherwise, it will expire. There may be limits on the number of Benefits you can receive, or other conditions such as time of day, day, or availability at some McDonald’s restaurants. Subject to law (including your rights under the Australian Consumer Law), these Benefits and conditions may be changed without notice.

3.4 Subject to your rights under the Australian Consumer Law (ACL) and these Terms, we are not responsible if a Benefit is or becomes unavailable. If a Benefit or part of it becomes unavailable for a reason beyond our reasonable control, we can award a similar item of equal or greater value. Also, subject to your rights under the ACL, we are not responsible for any variation in Benefits or their value.

3.5 Benefits cannot be used in conjunction with any other Benefit, claim, offer, upgrade, promotion or discount or similar. Food or beverage Benefits are only valid for the specific item stated (including size, type and flavour), and cannot be used in combination to claim or discount any McDonald’s meal deal combos or bundles. We can substitute ingredients as a result of seasonal variation, supplier changes or other factors.

3.6 It is your responsibility to ensure that Benefits are suitable for you.

3.7 McDonald’s or the Benefit Partner may ask you to provide photo ID to confirm you are the Account holder before you can redeem a Benefit.

3.8 Benefits must be taken as offered and cannot be sold, transferred, assigned or otherwise dealt with. Benefits are not replaceable if lost or stolen. Benefits will be void if any tokens, certificates or other validations are stolen, forged, mutilated or tampered with in any way. Benefits are not exchangeable and cannot be taken as cash. We have no responsibility for any tax implications – you should seek your own advice.

3.9 If a Benefit Partner is providing the Benefit, they are responsible for the Benefit, not us, and they are not our agent (and we are not their agent). If you have questions about the Benefit, you should ask the Benefit Partner. Subject to your rights under the Australian Consumer Law, we are not liable for availability, quality or fitness for purpose of Benefits offered by a Benefit Partner.

  1. Contributions

4.1 Sometimes we will invite you to contribute ideas, submissions or other content, to participate in polls, or to interact with the Service (Contribution). Contributions will be made public.

4.2 By making a Contribution, you assign all your intellectual property rights in the Contribution to us. We can modify or delete your Contribution and we don’t have to acknowledge you as the author or make any payment to you. We can feature your Contribution on social media platforms.

4.3 By making a Contribution, you also consent to our using the Contribution and your name, likeness, image and/or voice (including photograph, film and/or recording), in any media worldwide for an unlimited period of time.

4.4 Each time you make a Contribution, you warrant that:

  • your Contribution is your original creation;
  • you have the right to make the Contribution and to assign rights in it to us;
  • information in the Contribution is accurate and not misleading or deceptive;
  • your Contribution doesn’t infringe the rights of any third-party, including privacy rights, intellectual property rights and contract rights;
  • your Contribution isn’t illegal or in breach of any regulation, indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, libellous, offensive, objectionable, in support of terrorism, or disparaging to any person;
  • your Contribution doesn’t contain content that has been used in previous marketing for any third-party and you won’t submit your Contribution to any third-party for any commercial purpose; and
  • your Contribution doesn’t contain any harmful or malicious code.

4.5 You waive claims against us for use of any idea, product, design and/or concept similar or identical to any idea, product, design and/or concept in your Contribution.

4.6 If a law enforcement authority or court asks or requires us to disclose your identity because of allegations of illegal or inappropriate Contributions, we will fully co-operate with the request or requirement. If a third-party requests or requires us to remove your Contribution, then it is our decision whether to do so, without liability or notice to you.

4.7 You are liable for any harm caused to people or property, illegal conduct, or breach of other people’s rights arising from your Contributions. You will co-operate with us in any legal action relating to your Contribution when we reasonably request it.

4.8 Do not rely on the Contributions of others. They are not the views of McDonald’s. We are not responsible for the content of Contributions even if they are defamatory, incorrect, illegal or offensive.

  1. MyMacca’s Rewards

5.1 Thank you for participating in the MyMacca’s rewards program (Rewards).

5.2. These Rewards program terms apply only if you participate in the Rewards program.

5.3 The MyMacca’s App sets out all the information you need about how to earn and redeem rewards points. You can check your points balance, history and any rewards you have earned in the Rewards & Deals section of the MyMacca’s App.

5.4 You will receive 100 rewards points for every one (1) dollar that you spend on food and beverages, based on the sub-total before any rounding. You can accumulate a maximum of 40,000 points at any one time. This limit does not include points awarded as part of a McDonald’s competition. You will reach an earning cap after 20 transactions (which includes both earning transactions and redemption transactions) in a rolling 24-hour period (“Earning Cap”). Any transactions placed after reaching the Earning Cap will not earn reward points (if they are made in the same 24-hour period as the first 20 transactions) but will still be counted towards your Earning Cap and may impact when you can start earning points again. For example: if you make 23 transactions in a 24-hour period, you do not earn points on the last 3 transactions and you will need to wait until 24 hours from your 23rd transaction to start earning points again.

5.5 You can earn points on any McDonald’s restaurant food and beverage item that you buy. Non food and beverage items are excluded from the Rewards program. Donations to Ronald McDonald House Charities (including roundups), and purchase of Ronald McDonald House items or products like Silly Socks, are also excluded from the Rewards program.

5.6 You can use your points to redeem free items on the MyMacca’s Rewards menu if you have enough points. The Rewards menu will tell you how many points are required for each reward item. The Rewards menu can change from time to time and reward items are subject to availability. Once you have redeemed your reward, the number of corresponding points for that reward will be deducted from your Account. Even if a reward is displayed on the Rewards menu, the reward may not be available at certain restaurants as those restaurants may not offer the reward item.

5.7 You can also earn points and redeem free items on the MyMacca’s Rewards menu on eligible orders made using the McDelivery Platform (via the MyMacca’s App only). Limited order amounts may apply. The following are not considered qualifying purchases for delivery orders and will not earn points:

  • delivery fees;
  • service fees;
  • small order fee; and
  • delivery tips.

5.8 If you cancel your order before a third-party delivery partner is assigned, you will not earn any points, and any rewards you redeemed will be returned to your Account as an active reward.

5.9 If you order and pay through the MyMacca’s App, you will automatically earn points on eligible orders. If you place an order at the front counter, at a kiosk or in drive thru you must provide your one-time code from your MyMacca’s App at the time of placing the order.

5.10 It can take up to 24 hours for your Rewards points to appear in the MyMacca’s App, but in some cases may take longer. If you believe that points from your eligible purchase have not appeared in your MyMacca’s App or you believe that they were calculated incorrectly, you will need to contact McDonald’s either through the MyMacca’s App or through customer service and provide your receipt. McDonald’s has the ultimate discretion to award points and accepts no responsibility for any loss suffered as a result in delay in awarding points, except to the extent permitted by law. 

5.11 We may reverse any points awarded to your account in the event that the products purchased are returned or cancelled, or because there is a dispute in relation to the purchase.

5.12 If you delete your MyMacca’s App, you will permanently delete your MyMacca’s Rewards program. Any points accumulated will be lost and cannot be retrieved or used. If we believe that your Account is using the Rewards program excessively, unreasonably or in a fraudulent manner we can, in our sole discretion (acting reasonably), decide to terminate your MyMacca’s Rewards program or reduce, delete or void any Benefits, points, or rewards earned, subject to your rights under the Australian Consumer Law.

5.13 Any points accumulated or rewards earned through the MyMacca’s Rewards program are non-transferable. Points cannot be combined across multiple MyMacca’s App accounts. Points have no cash value.

5.14 Your points will expire on the 2nd day of the month after 12 months from the date they were earned. Points will remain in your MyMacca’s App until they are redeemed or until they expire, whichever occurs first. McDonald’s may elect to terminate the MyMacca’s Rewards program at any time and, subject to your rights under the Australian Consumer Law, any unused points will expire and be void when the MyMacca’s Rewards program is terminated.

5.15 Once you select a reward and exchange your points for it, the reward will be displayed in your bag (if you have selected “Add to Mobile Order”) or display in a code (if you have selected “Use Restaurant Code”). The reward will temporarily remain in your bag or displayed in a code until you redeem it for a product. If you cancel your transaction before it is submitted, or if the transaction fails to complete, your reward will still be available to be redeemed in the “Ready to Redeem” section of Rewards within the MyMacca’s App. The reward will remain there for 14 days, after which time it will expire and you will no longer be able to redeem it.

  1. The McDelivery Platform and the MyMacca’s App

6.1 The McDelivery Platform (via the MyMacca’s App or third-party delivery providers) allows you to order McDonald’s for home delivery from participating McDonald’s restaurants in Australia. These McDelivery Platform terms apply to any delivery orders you place in the delivery program.

6.3 When you use the McDelivery Platform outside the required geographic areas, the McDelivery Platform will not be available to you.

6.4. You need to be a MyMacca’s member to use the McDelivery Platform (via the MyMacca’s App) and the MyMacca’s App (please see section 2 above). You will also be subjected to registration requirements of third-party delivery providers, as well as their terms and conditions.

6.5 McDonald’s uses third-party delivery providers for McDelivery. You acknowledge and agree that the third-party delivery provider is responsible for: collecting the McDelivery order; providing the delivery services; and managing customer support for McDelivery orders, refund escalations, and food quality complaints (Customer Enquiries). The third-party delivery partner will refer Customer Enquiries to the relevant McDonald’s restaurant to process and/or resolve. For customer support regarding points earned or redeemed please refer to section 5.

6.6 To use the McDelivery Platform, you will need to enter personal information (including your address, name, and phone number). McDonald’s will share the information you enter with the third-party delivery provider assigned to your order. This information will be handled in accordance with the McDonald’s Privacy Policy and/or the third-party delivery partner’s privacy policy, if applicable.

6.7 McDelivery orders are subject to a delivery fee (this amount varies for each restaurant), service fee (calculated from pre-discounted subtotal), small order fee (this fee is charged on orders with a subtotal below a certain amount), and goods and services tax. You will have the opportunity to review the price of your order (including the fees) before you select ‘Place Order’.

6.8 Prices for items for McDelivery orders may be higher than the prices for the same items for pick up. Certain offers and pricing may not be available for all orders at all locations. Item prices may be different if you switch restaurants or change how you’re getting your order. Updated order totals can result from the unavailability of certain products, changes in price, or other reasons.

6.9 As product availability and pricing may vary from restaurant to restaurant, McDonald’s cannot guarantee that the order you generate using the McDelivery Platform or the MyMacca’s App will be available for the same total cost by the time your order is processed.

6.10 As the restaurant locator relies on third-party systems, McDonald’s does not promise that the restaurant locator will be available or accurate at all times. Trading hours are correct at time of publishing but subject to variation.

6.11 We calculate McDelivery service areas based on driving time and distance and restaurant capacity. Your closest McDonald’s restaurant may not be the restaurant that fulfils your order. For orders on the MyMacca’s App, you will not be able to choose the restaurant or the third-party delivery provider. If for any reasons you want a specific restaurant to fulfil your order (for example, a restaurant with Halal certified products), please visit us in restaurant.

6.12 We will start preparing your McDelivery order when it reaches the head of the queue and a third-party delivery provider is available. Quoted delivery times are estimates only and may be affected by traffic, weather and order volume. We give you an estimated time at the start of the order process and when you confirm your order to give you the most up to date time.

6.13 McDelivery service areas are constantly changing as we allocate delivery areas to try to deliver the freshest possible products and to meet changing demand. Sometimes, you will find that you are no longer within the delivery area.

6.14 The MyMacca’s App allows you to order McDonald’s for pick up at a McDonald’s restaurant.

6.15 For orders on the MyMacca’s App, you must be within a certain distance of a restaurant (“Zone”) before your order will be sent to a restaurant, and your order will be sent to the first restaurant’s Zone that your mobile device enters after placing your order on your mobile device.

6.16 We will start preparing your MyMacca’s App order when the mobile device you ordered on is within the restaurant’s Zone.

6.17 From time to time, we may change the size and shape of the Zone, for example to make sure your order is ready for your arrival, to accommodate for local factors around a restaurant. For the MyMacca’s App to work, you need to enable location services on your device, and you need to have your device with you when you enter the Zone. If you enter the Zone without your mobile device or without location services enabled, your order will not be sent to our kitchen for preparation.

6.18 When you place an order via the McDelivery Platform and the MyMacca’s App, you purchase the meal items you have selected and you will be given a unique order code.

6.19 The McDelivery Platform and the MyMacca’s App may only be used in Australia and only in respect of meal items generally available at participating McDonald’s restaurants across Australia.

6.20 Please refer to section 5 regarding points earned and redeemed on eligible McDelivery Orders.

  1. Payment

7.1 Before you submit an order on the MyMacca’s App or McDelivery Platform, you must register a credit card or debit card (payment card) or use another payment method that McDonald’s supports to use with your orders. You must only use payment cards and methods that you are old enough to use legally, and have the legal right to use.

7.2 Shortly after you register a payment method on the MyMacca’s App or McDelivery Platform, a small verification transaction may appear on your account. The transaction will be for a small amount – for example it may be for $0.01 or approximately $1 depending on your card. The transaction is required to verify your payment method. The transaction may appear as pending for up to 10 working days then should disappear. In many cases the transaction will only appear for 1 to 3 days.

7.3 McDonald’s restaurants use third-party providers to securely store your payment card information and process your payments to restaurants and third-party delivery providers.

7.4 You do not make your purchase until you select ‘Place Order’, and your payment method will be charged upon clicking ‘Place Order’. When you select ‘Place Order’ you authorise the restaurant to process your order total.

7.5 When you order on the McDelivery Platform (via the MyMacca’s App), you have the ability to update or abandon your order at any time prior to clicking ‘Place Order’. If you would like to attempt to cancel your order after placing your order or you would like to seek a refund for any reason, or if you have any other questions about your order, please contact the McDelivery Customer Service line on 1800 865 214. If you order on the McDelivery Platform via third-party delivery providers, please contact them directly for customer support services.

7.6 You must pay in full at the time of order by one of the methods shown on the McDelivery Platform and the MyMacca’s App. McDonald’s does not accept cash or cheques as a payment option for the McDelivery Platform or the MyMacca’s App. If we can’t process your payment, we won’t be able to fulfil your order. We won’t be liable to you when we can’t process your payment.

7.7 The restaurant’s payment service provider will process your order total amount to the payment card you selected when you built your order.

7.8. For in-restaurant use of the MyMacca’s App, requests should be directed to the manager of the relevant restaurant.

  1. Promotions & Vouchers

8.1 In-restaurant promotions may not be available via the McDelivery Platform or the MyMacca’s App. Where a promotional product, meal or price is not available for McDelivery or mobile ordering, it will not be available for selection at the time of order via the McDelivery Platform or the MyMacca’s App.

8.2 McDonald’s vouchers are not redeemable through McDelivery or the MyMacca’s App unless specifically stated on the voucher terms. If a voucher is redeemable through McDelivery or the MyMacca’s App, you must enter the code when placing the order or following the directions of the voucher. McDelivery drivers will not accept vouchers.

  1. McDelivery Menus and Ordering

9.1 The McDelivery Platform and MyMacca’s App menus are different from the full McDonald’s menu available in-restaurant. Please check the McDelivery Platform or MyMacca’s App menu carefully when placing your order.

9.2 All prices are in Australian Dollars (AUD). Pricing is not real time but is correct at time of publishing. Prices may vary at time of purchase. Prices may differ from in-restaurant prices.

9.3 McDonald’s always recommends you review your order prior to payment before deciding whether or not you wish to proceed with your purchase. We are not liable for any price variations or errors in pricing.

9.4 It is your responsibility to ensure that your food or beverage order, and/or any Benefits you claim, are consistent with your dietary requirements including any intolerances or allergies.

  1. Use of the Service

10.1 You download, install, access and use the Service at your own risk and cost, including Internet service provider costs.

10.2 All material and logos on the Service remain our property.

10.3 You must not attempt to decompile, reverse engineer, disassemble or otherwise convert the Service.

10.4 The Service is only for use in Australia.

10.5 Use your own judgement when using the Service and take care of your personal safety. Never use the Service when driving.

10.6 We are not responsible for the content of any other websites, social media platforms or applications linked on the Service. They may have their own terms.

10.7 The Service may link to social media platforms and access information you have shared with those platforms, and/or contact you via those platforms or information (for example, sending an email directly to you to the email address provided to the social media platform).

  1. Privacy

11.1 We collect, use and disclose your personal information in accordance with any privacy collection statement that we give you, and as stated in these Terms.

11.2 We collect and use your personal information through the Service for the purposes disclosed when we collect the information and to allow you to:

  • register an Account,
  • receive and redeem Benefits,
  • make Contributions;
  • otherwise use and interact with the Website,
  • and to allow us to:
    • contact you with information about the Service and McDonald’s generally, including special offers, market research or marketing materials via any method;
    • share your information with our Australian and overseas related entities, officers and agents, third-parties and promotional purposes, who may also contact you for similar purposes;
    • manage your orders, including by using or displaying your name at the restaurant, at a kiosk or on the drive thru screens to identify your order or to greet you by name. This will help to ensure we have the right order;
    • to share your personal information with our business partners if they are involved in your customer service, including product or service delivery (e.g., food delivery platforms or third-party delivery service providers); and
    • use and disclose your personal information for other reasonable related purposes.

11.3 If you decide not to provide us with your personal information, that’s ok, but we may not be able to process your MyMacca’s membership or accept Contributions, or provide you with Benefits, or allow you to order using the McDelivery Platform or the MyMacca’s App, and it may restrict your ability to use the Service overall.

11.4 Keeping your personal information safe is important to us. Sometimes your information, including the payment card details that you provide for McDelivery Platform orders, will be processed and stored overseas by us or our service providers, and we have confidentiality and security requirements for processing and storage. However, security of communications cannot be guaranteed and to the extent permitted by law we are not liable for unauthorised access.

11.5 When you use the McDelivery Platform and MyMacca’s App, you consent to our use and disclosure of the location of your device, so that we can provide functions like restaurant location to you.

  1. General

12.1 We can monitor Account activity. We can terminate or suspend your Account, your MyMacca’s membership, your participation in any of our promotions (including the Monopoly Game), and/or your Website access in our discretion, including if we see signs of fraud, criminal, abuse or suspicious activity, or any breach of these Terms. We reserve our rights in the case of any breach of these Terms, or any terms of the promotion, or our rights, or any unlawful activity.

12.2 If we believe you are using any automated software or other mechanical or electronic automated method to accept MyMacca’s membership or receive and/or redeem Benefits, or to take advantage of MyMacca’s Rewards or other promotions, we can suspend or terminate your Account, your MyMacca’s membership, your ability to place orders on the McDelivery Platform or the MyMacca’s App, and/or your Website access.

12.3 To the extent permitted by law, the Service is provided on an "as is" and "as available" basis without any warranties of any kind either expressed or implied. We will use reasonable efforts to make the MyMacca’s App available at all times, however the quality and availability of the MyMacca’s App may be affected by factors outside our reasonable control such as network issues or technical malfunction. McDonald's disclaims all warranties of merchantability, non-infringement and fitness for a particular purpose or that the Service will be error-free or free from harmful code.

12.4 To the extent permitted by law, we have no liability for any loss or claim that you may suffer or incur as a result of your use of the Service.

12.5 Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You have rights under the ACL for major and minor failures. In addition to other entitlements, for a major failure you may be entitled to a refund or compensation for the reduced value of goods or services. For a minor failure, we may choose to provide you with a replacement or refund for goods or services, or re-supply a service.

12.6 To obtain compensation, you will need to provide documentary evidence of the loss or damage suffered, and documentary evidence that such loss or damage was a reasonably foreseeable consequence of our failure to comply with a consumer guarantee under the ACL.

12.7 The type of remedy we will offer you may vary depending on how long it takes you to make a claim.

12.8 We are committed to helping customers make informed decisions about their food and beverage choices. McDonald’s provides healthier food and beverage options for adults and children and ensures nutritional information is easily accessible to its customers. Nutritional information is available on our website www.mcdonalds.com.au, in our restaurants and, where practical, on product packaging.

12.9 Our decisions about all aspects of MyMacca’s and Benefits are final and no correspondence will be entered into.

  1. Governing Law & Amendments

13.1 These Terms are governed by the laws of NSW. You submit to the exclusive jurisdiction of the Courts of NSW and the Commonwealth of Australia in respect of all matters and things arising out of these Terms and Conditions.

13.2 We amend these Terms when needed and without notice to you, so you should check them from time to time. Your use of our Service, following any changes, is your acceptance of those changes.
