McDONALD’S PARTIES AND EVENTS
1. McDonald’s party and event booking website accessible via https://mcdonalds.com.au/parties (McDonald’s Parties), and their associated platforms are owned and operated by McDonald’s Australia Limited (ABN 43 008 496 928) and/or any of its franchisees, affiliates, subsidiaries or related bodies corporate (McDonald’s or we, us or our).
2. These are the Terms that govern the relationship between you and McDonald’s when you book a McDonald’s birthday party or event.
BOOKING A MCDONALD’S BIRTHDAY PARTY OR EVENT
3. McDonald’s Parties allows adults to book a McDonald's birthday party or event online. By making a booking through McDonald’s Parties you:
a. confirm that you are 18 years old or over. McDonald’s reserves the right to cancel any birthday party that has been booked online by a person under the age of 18;
b. agree and understand that it is a tentative booking. Your booking will only be confirmed once the McDonald’s restaurant has contacted you to confirm your booking.
4. McDonald's accepts no liability for any loss or damage, however caused which may be directly or indirectly suffered as a result of your reliance on the McDonald’s Parties website as confirmation of the birthday party or event booking.
5. To reduce booking fraud, the person making the booking will need to register as a user, providing a valid email address. An email will be sent to the email address provided and to finalise and complete the booking the user must click the link in that email. Failure to complete this step will result in the booking being incomplete and not entered into the system.
6. McDonald's Parties handles the booking and cancellation of a McDonald's birthday party or event only. Once your booking is confirmed by the McDonald's restaurant, you will need to contact the restaurant directly for any further inquiries.
PURCHASING A MCDONALD’S BIRTHDAY PARTY OR EVENT
7. Prices for birthday party packages, events, and optional extras (such as party cakes) include all taxes, unless otherwise stated on the McDonald’s Parties website. Payment for the cost of the party is to be made at the restaurant at the time of the party by cash, EFTPOS or credit card. Not all payment methods may be available at all restaurants. Prices published on the McDonald’s Parties website are subject to change without notice and may vary between restaurants.
8. Changes and cancellations to a McDonald’s birthday party or event can be made by contacting McDonald’s Customer Service on 02 9875 7100.
MCDONALD’S BIRTHDAY PARTY AND EVENT RESTRICTIONS AND REQUIREMENTS
9. A 10 guest minimum applies to all party bookings. Adults attending in a supervisory capacity do not count as guests for the purpose of this condition (Supervising Adult). The maximum number of party or event guests allowed varies depending on the restaurant chosen. A minimum of 1 Supervising Adult is required to remain in attendance for the entirety of the party. McDonald's recommends that 1 adult per 10 children in attendance be present to supervise.
10. McDonald’s birthday party hosts do not provide direct supervision for each child attending the party venue. Supervising Adult(s) are expected to be in control of their birthday party or event group at all times. This includes adhering to the PlayPlace Rules, which are located at near the playground if the playground is being used. Anyone misbehaving during the birthday party may be asked to leave.
11. You are responsible for ensuring that at least one of the Supervising Adult(s) will have the contact details of the parents whose children will be attending the birthday party or event. Supervising Adults are responsible for children under their supervision.
12. If any person attending the McDonald’s birthday party or event is misbehaving, not adhering to the PlacePlace Rules, or directions of McDonald’s staff, McDonald’s reserves the right to ask the guest to leave, cease hosting the birthday party or cancel the event immediately. Should this occur, you will still be required to pay for the cost of the McDonald’s birthday party or event.
13. McDonald’s takes all reasonable steps to provide a safe experience. However, McDonald’s will not be liable to any person in attendance at a McDonald’s birthday party or event, in respect of any injury or illness, loss or damage whether that injury, illness, loss or damage is caused by any person’s negligence or otherwise. This exclusion of liability does not apply to liability which cannot by law be contracted out of.
14. You are responsible for any damage to McDonald’s property caused by all persons, both children and adults, in attendance at a McDonald’s birthday party or event.
15. McDonald’s recommends that birthday parties or events be booked for and attended by children aged 3 years and above. Games, toys, and accessories provided as part of each birthday party or event package have been safety tested and recommended only for children aged 3 years and above. McDonald’s playgrounds are also only suitable for children aged 3 and above. Any parent, guardian, adult or other person booking a birthday party or event for a child under 3 years, or which will be attended by a child or children under 3 years expressly acknowledges this information and indemnifies McDonald's and its affiliates for any loss, claim or damage as a result of the booking.
FOOD AND DRINKS
16. Birthday party packages or events do not incorporate food or beverages for Supervising Adult(s), however food and beverages in addition to the party packages may be purchased from the restaurant on the day.
17. Customers may elect to bring their own birthday cake or may purchase a McDonald's birthday cake through the McDonald’s Parties website. Customers who bring their own birthday cake do so at their own risk. McDonald's accept no liability for any loss, injury, illness or damage, however caused which may be directly or indirectly suffered in connection with food products brought to a birthday party or event which are not supplied by McDonald's.
18. With the exception of a birthday cake, no external food or beverage is permitted, unless in relation to a food allergy which the restaurant has been made aware of, or unless prior consent is given by the restaurant.
19. McDonald’s is committed to helping its customers make informed decisions about their food and beverage choices. McDonald’s provides healthier food and beverage options for adults and children and ensures nutrition and allergen information in respect of McDonald's food and beverages (including the cakes available for birthday parties or events) is available to view in its restaurants and on the McDonald's website; please go to https://mcdonalds.com.au/maccas-food/nutrition to access this information.
20. Any 'Special Offers' posted on the Find a Party Restaurant and Select a Restaurant pages have been inputted directly by the relevant restaurant. McDonald's accepts no liability for any loss in connection with these special offers as these offers are made by the individual restaurant and not by McDonald's. Any queries or concerns in relation to a special offer should be addressed to the particular restaurant making the offer.
21. These terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the Courts of New South Wales and the Commonwealth of Australia in respect of all matters and things arising out of these Terms and Conditions.
22. We may amend these terms when needed and without notice to you, so you should check them from time to time. Your use of our website, following any changes, is your acceptance of those changes.
PRIVACY COLLECTION NOTICE
McDonald’s Australia and its franchisees are committed to protecting your personal information in accordance with the Australian Privacy Principles contained in the Privacy Act 1988. When you book a McDonald’s birthday party or event, you will be providing us with personal information, such as your name, address, telephone number, email address. This information is collected to facilitate the booking and arrangement of your McDonald’s birthday party or event.
We may share your information with McDonald’s franchisees, affiliates, subsidiaries of McDonald’s (the McDonald’s Group) or other third parties that assist us in conducting our business for these purposes or other related purposes you would reasonably expect. This may require transferring your information outside of Australia to any McDonald’s Group company or third-party services providers that help McDonald’s provide services. If you do not provide the necessary personal information, we may not be able to arrange a McDonald’s birthday party or event for you. Our Privacy Policy contains information about how you can access and correct your personal information, how you can lodge a complaint regarding the handling of your personal information and how any privacy complaint will be handled by McDonald’s.
